Your use of this Site is subject to the terms and conditions laid down below.

This Services Agreement (the "Agreement") contains the complete terms and conditions that govern your subscription to Social Media Presence Boosting tools provided by DiziVizi Cards via mobile application and website (the "SERVICES"). As used in this Agreement, "DiziViziCards" means DiziVizi Cards, and "Client", "you", or "you're" means you. You acknowledge that you have read the Agreement, and you agree to its terms and conditions and all policies posted on the DiziVizi Cards site. As referred to in this Agreement, "Site" refers to a World Wide Web site, and " DiziVizi Cards Site" refers to the Site located at the URL www.dizivizicards.com or any other successor Sites owned or maintained by DiziViziCards.

By using this Site, you represent warrant, and covenant that you shall abide by all the terms and conditions contained herein. We reserve the right to change these Terms & Conditions. entirely or any part thereof, at any time without giving you any prior notice. PROJECT TERMS

To access the service and websites, you must register for a DiziVizi Cards account by creating a username and password. The client will receive services according to the purchased item at www.dizivizicards.com.

By accepting a quote, you agree to and accept the terms and conditions of DiziVizi Cards. Acceptance can be verbal, by email, payment of Initiation, or by signing a quote.

Request for the changes to be made in the features of functionality is not accepted.

WHAT IS INCLUDED IN YOUR SUBSCRIPTION AND WHAT ARE THE RESTRICTIONS

ACCESS TO DiziVizi Cards SERVICES

Subject to these Terms and during the applicable Subscription Term, you may access and use the DiziVizi Cards for your business purposes or personal use, as applicable, all in accordance with these Terms, the applicable Order, and the Documentation. This includes the right, as part of your authorized use of the DiziVizi Cards Services. The rights granted to you are non-exclusive, non-sublicensable, and non-transferable. Users can purchase multiple services at the same time.

RESTRICTIONS

Except as otherwise expressly permitted in these Terms, you will not: (a) reproduce, modify, adapt or create derivative works of the DiziVizi Cards Products; (b) rent, lease, distribute, sell, sublicense, transfer or provide access to the DiziVizi Cards Products to a third party; (c) use the DiziVizi Cards Products for the benefit of any third party; (d) incorporate any DiziVizi Cards products into a product or service you provide to a third party; (e) interfere with or otherwise circumvent mechanisms in the DiziVizi Cards Products intended to limit your use;(f) remove or obscure any proprietary or other notices contained in any DiziVizi Cards Product; (g) use the DiziVizi Cards Products for competitive analysis or to build competitive products; (h) publicly disseminate information regarding the performance of the DiziVizi Cards Products; or (i) encourage or assist any third party to do any of the foregoing.

CHARGES

Charges for services to be provided by DiziVizi Cards are defined in the service quotation that the Client receives.

The charges are to be paid according to the service opted by the client.

ADDITIONAL CHARGES

Additional charges are subject to the selected service by the user.

ADDITIONAL EXPENSES

The client agrees to reimburse Omkaar Group for any additional expenses necessary for the completion of the work.

DISPUTES/LIABILITY AND INDEMNITY

In the event of a dispute, Omkaar Group reserves the right to charge the client in full for the work done as well as for the resources spent in managing the dispute. In such an event, Omkaar Group reserves the right to charge the client without honouring any discounts that were previously honoured in good faith. Under no circumstances will Omkaar Group be liable for any damages arising from misrepresentation or misinformation.

Omkaar Group reserves the right to refuse service to any client if these are not aligned with our business operating principles and policies.

Omkaar Group provides its services as it is, without any guarantees on security or other issues leading to loss of data, sales, or reputation. We ensure to the best of our ability that our systems and servers are protected from hackers, viruses, intruders, and other online and offline problems; however, we will not be held liable for any disruption of services if such a situation arises.

The client will indemnify and hold Omkaar Group, its licensors, content providers, service providers, employees, agents, officers, directors, contractors, and sub-contractors (the “Indemnified Parties”) harmless from your breach of any of these Terms and Conditions or any other terms, conditions, policies or procedures herein, including, without limitation, any use of the Content other than as expressly authorized in these Terms and Conditions. Client agrees that the indemnified parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify and hold harmless the Indemnified Parties from any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys’ fees in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of the information obtained from Omkaar Group.

Omkaar Group will not be liable for any breach of the agreement which is caused by a matter beyond its reasonable control including but not limited to Acts of God, fire, lightning, explosion, war, disorder, flood, earthquake, industrial disputes (whether or not involving their employees), extremely severe weather, or acts of local or central government or other competent authorities.

INTELLECTUAL PROPERTY RIGHTS

All content of this website is a property of Omkaar Group unless otherwise specified. Omkaar Group reserves the right to change the content or policies without any prior notice.

If you use the links to the websites of DiziViziCards affiliates or service providers, you will leave the Site and will be subject to the terms of use and privacy policy applicable to those websites. Omkaar Group is not responsible for the critical changes made by the API provided by Cloutsy.net they are using like Instagram, YouTube, Facebook, TikTok, Spotify, Twitter, LinkedIn, Telegram, AppStore, and many more. Although the latest version of the script is mostly updated, Omkaar Group does not guarantee the compatibility of the Script with Cloutsy.net API.

Refund & Cancellation

Omkaar Group owns, operates and maintains the website at www.dizivizicards (“Site“) to provide and disseminate information about DiziViziCards and the services, and opportunities it provides

Omkaar Group reserves the right to refuse/cancel any order. Omkaar Group at its sole discretion may cancel any order(s):

i.                    If it suspects a fraudulent transaction, or

ii.              If it suspects a customer has undertaken a transaction which is not in accordance with the Terms of Use or

iii.                For any reason outside the control of the Omkaar Group.

Refund/cancellation policies are applicable under the following conditions:

a)      If the user has opted for a yearly plan, the cancellation will be on a pro-rata basis and the charges will be calculated according to the prices involved in a monthly plan.

b)      Benefits provided in the yearly plan will not be calculated at the time of the cancellation. 

GOVERNING LAW

This agreement shall be governed by Indian Law. You agree to the sole and exclusive jurisdiction of the Courts in Indore in the event of any dispute of any kind arising from or relating to these Terms & Conditions, DiziViziCards’s Privacy Policy, your use of the Site, or the Content

FORCE MAJEURE

Neither party will be liable to the other for any delay or failure to perform any obligation under these Terms (except for a failure to pay fees) if the delay or failure is due to events that are beyond the reasonable control of such parties, such as a strike, blockade, war, act of terrorism, riot, natural disaster, failure or diminishment of power or telecommunications or data networks or services, or refusal of a license by a government agency.

DELETION OF PERSONAL DATA

At DiziVizi Cards, we respect your privacy and provide you with the right to request the deletion of your personal data in accordance with applicable laws and regulations. If you wish to have your personal data removed from our systems, please contact us at the following email address: enquiry@dizivizicards.com. Upon receiving your request, we will take all reasonable steps to promptly delete your personal data, unless retention is required by law or for legitimate business purposes.

Please note that even after your personal data is deleted, residual copies may still remain in our backup systems for a limited period of time. We will ensure that such copies are securely stored and not accessible for any other purpose.

SEVERABILITY

Such invalid, illegal, or unenforceable provision shall be replaced by a mutually acceptable valid, legal, and enforceable provision, which comes closest to the intention of the parties underlying the invalid.

ENTIRE AGREEMENT/NO WAIVER 

These Terms & Conditions constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by Omkaar Group of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

CORRECTION OF ERRORS AND INACCURACY

The Content may contain typographical errors or other errors or inaccuracies and may not be complete or current. Omkaar Group, therefore, reserves the right to correct any errors, inaccuracies, or omissions and to change or update the Content at any time without prior notice. Omkaar Group does not, however, guarantee that any errors, inaccuracies, or omissions will be corrected.
